Under NRS 453.337 and 453.338, it is unlawful for an individual to possess any controlled substance with the intent to sell it. If an individual is in possession of a narcotic, and he or she plans or attempts to distribute it, he or she can be charged with a criminal offense.

If an individual is convicted of this offense for a third time, he or she will be punished under the guidelines of a category B felony, which carries a prison sentence of three to 15 years, and/or a fine of up to $20,000.

If an individual sells or attempts to sell drugs in Schedule III, IV, or V, he or she can be charged with a category D felony and sentenced to one to four years in prison, and/or a fine of up to $10,000. A third or subsequent offense is a category C felony, and is punishable by one to five years in prison, and/or a fine of up to $10,000.
