Laws Regarding Prescription Drug Possession

According to NRS 453.336, it is against the law for an individual to knowingly or intentionally possess a controlled substance that has not been legally prescribed to him or her by a licensed medical professional operating in the course of their professional practice. Prescription drugs that are commonly obtained illegally in Las Vegas include:

  • Xanax
  • Vicodin
  • Morphine
  • Ritalin
  • Oxycontin
  • Hydrocodone
  • Codeine
  • Ativan
  • Percocet
  • Valium

 

Illegally Obtaining a Drug Prescription

If an individual has a prescription for the drug but it is later determined that the prescription was obtained unlawfully, the individual can face enhanced criminal charges. Individuals are commonly charged with prescription drug fraud for obtaining controlled substances through fraud, forgery, misrepresentation, or other false pretenses.

Penalties for Illegally Possessing or Acquiring Prescription Drugs

For a first or second offense of illegal possession of a prescription drug, an individual will typically be charged with a category E felony. This offense is punishable by one to four years behind bars, and a fine of up to $5,000.

If an individual has previously been convicted of this offense or another other drug related offense two or more time, he or she will be charged with a category D felony for any subsequent offenses. A category D felony is punishable by one to four years in prison, and in this case, according to NRS 453.336(2) (b) the individual can face a maximum fine of $20,000.

It is a category C felony if an individual obtains prescription drugs through fraudulent means. A category C felony is punishable by one to five years in prison, and a fine of up to $10,000.
