Under NRS 453.337 and 453.338, it is unlawful for an individual to possess any controlled substance with the intent to sell it. If an individual is in possession of a narcotic, and he or she plans or attempts to distribute it, he or she can be charged with a criminal offense.

A third or subsequent offense is a category C felony, and is punishable by one to five years in prison, and/or a fine of up to $10,000.
